NOTE:

Throughout
this Service Contract, the words, “We”, “Us”, and “Our” refer
to AIG Warranty Services and Ins
urance
Agency, Inc. (“AIGWS”). The words, “You” and “Your” refer
to the Contract Holder or the person to whom the Service Contract
was properly transferred.
TERM
and COVERAGE:
For products qualifying for sale with a repair plan, the term
of this Service Contract commences after the expiration of
the manufacturer’s warranty. The term length purchased can
be confirmed by referencing your sales receipt. This Service
Contract covers qualifying products sold in USA only.
1. SERVICE:
For
service on Your product during the manufacturer’s warranty
period, please contact the manufacturer at the number or website
listed in Your owner’s manual. After
the manufacturer’s warranty expires, please call 1-888-969-2260.
·
Arrangements
will be made to have your product serviced On-Site.
·
Due
to environmental and technical requirements, some products,
such as but not limited to, laptop computers, may require
shipping the product to a designated location for repair rather
than repairing them on-site. In this case, all shipping charges
will be covered under this Service Contract.
·
Repair
Service will be available during normal business hours, Monday
through Friday, and will be provided by a manufacturer authorized
service center or someone we designate.
·
All
Service Contract coverage is applicable only to the items,
costs and time periods not covered by the express manufacturer
warranty regardless of whether the manufacturer is out of
business.
·
AT
OUR OPTION, REPLACEMENT PARTS OR REPLACEMENT PRODUCTS WILL
BE NEW OR REMANUFACTURED. NON-ORIGINAL MANUFACTURER’S PARTS
WILL PERFORM TO THE FACTORY SPECIFICATIONS OF THE ORIGINAL
PRODUCT.

If
Your product requires service and is located outside of the
U.S.A. or Canada, please call

If
the product is still covered by the manufacturer’s warranty,
You will need to contact the manufacturer for service locations
worldwide. If the product is out of the manufacturer’s warranty
period, We will ask you to locate service in Your area, to
get an estimate for the repair, to get an authorization from
Us for the repair, to remit payment to the service center
and to send Us the invoice. We will reimburse You for the
authorized amount of the claim in U.S. Dollars.
2.
ADDITIONAL
COVERAGES:
Power Surge Protection: This
Service Contract provides power surge protection in excess
of any other insurance coverage, from date of purchase of
this Service Contract. No
Lemon Guarantee: Following
the expiration of the manufacturer’s warranty term and after
three service repairs have been completed on the product covered
under this Service Contract within a twelve (12) month period,
and that covered product requires a fourth repair, as determined
by Us, We will replace it with a product of comparable performance,
not to exceed the original selling price of the product. Technical
advances may result in a replacement product with a lower
selling price than the original product. The original product
and purchase receipts must be returned to Us, along with three
separate service repair receipts from separate service repair
incidents, all authorized by Us, in order to qualify. One
service authorization number is equal to one repair. Keep
Your service receipts. Copies of service receipts cannot be
provided by Us. Preventive maintenance checks, cleanings,
product diagnosis, customer education, accessory repairs or
replacements, and computer software related problems are not
considered repairs for the purpose of this No Lemon Guarantee.
Once the product is replaced or cash settled at current market
value, this Service Contract is considered fulfilled. Laptop
Coverage: This
service contract covers LCD screens. Coverage includes express
shipping to depot servicer of our choice.
3.
SERVICE
CONTRACT LIMITS OF LIABILITY (Aggregate Limit):
The
total payment (s) for all claims under this Service Contract
shall not exceed the original selling price of the covered
product or system, except in those cases in which the No Lemon
Guarantee applies. If We determine that the product covered
under this Service Contract is irreparable, We may replace
the covered product with one of like kind, quality and functionality.
Once the product is replaced, this Service Contract is considered
fulfilled.
4.
PURCHASE
RECEIPTS AND SERVICE RECORDS:
This Service Contract and all original receipts may be required
for any service or replacement of the covered product. Please
keep them in a safe place.
5.
EXCLUSIONS
– WHAT IS NOT COVERED:
This
Service Contract DOES
NOT Cover:
·
Any
malfunction, defect, breakdown, or disruption of any product
functions or the function of any related component or software
arising from any design flaw caused by or arising from or
related to, directly or indirectly, any design, planning or
engineering incompatibility, omission, or deficiency with
the incidence of any date.
·
Loss
or damage caused by accidental or intentional physical damage,
spilled liquids, insect infestation, misuse, abuse, or service
costs or damage caused by unauthorized repair personnel.
·
Replacement
costs for lost or consumable parts (knobs, remote control
devices, cartridges, drums, batteries, etc.), problems due
to improper and/or unauthorized installation or repairs, and
cosmetic damage (such as cracked cases and broken hinges)
or defects that do not inhibit the proper operation and performance
of covered items.
·
Products
provided for public, commercial use or rental. Use of a product
for these purposes will void this Service Contract.
·
Loss
or damage to stored data; repairs related to software, computer
viruses, display markings caused by video games or computer
programs, or computer hardware that is added after the original
purchase.
·
Special,
indirect, consequential, or incidental damages.
·
“No
problem found” diagnosis.
·
Diagnostic
fees for non-covered repairs.
·
The
cost of data recovery or other consequential or incidental
damages.
·
Personal
items left in the product to be repaired.
·
Image
Burn
·
Theft
6.
SERVICE
CONTRACT HOLDER’S RESPONSIBILITIES:
We
strongly recommend (but do not require as a condition of this
Contract) the regular back up of the data and software.
7.
MANUFACTURER’S
RESPONSIBILITIES:
Parts
and services covered during the manufacturer's warranty period
are the
responsibility
of the manufacturer.
8.
RENEWAL:
If a renewal contract is offered by Us, the contract price
will reflect the age of the product and current service costs
at the time of the renewal.
9.
TRANSFER:
This Service Contract may be transferred to an eligible party
to whom You sell or give the covered product while this Service
Contract is in force. You must notify the Administrator in
writing at the address cited at the end of this contract of
the name and address of the new owner within fifteen (15)
days of the change of ownership. Proof of ownership will be
requested as part of the transfer documentation.
10. CANCELLATION:
You may cancel this Service Contract for any reason at any
time. To cancel this Service Contract, You must notify the
Administrator in writing at the address cited at the end of
this contract. If You cancel within thirty (30) days of receipt
of Your Service Contract, and We have not paid a repair claim
or replaced the product, You will receive a full refund of
the purchase price of the Service Contract. If You cancel
this contract after thirty (30) days after receipt of this
contract, or at anytime after We have paid a claim, You will
receive a pro rata refund of the Service Contract price based
on the days remaining less a cancellation fee of $25.00 or
10% of the Service Contract price, whichever is lesser. We
will not cancel this Service Contract except for: a) fraud,
b) material misrepresentation, c) non-payment of the Service
Contract price, d) violation of any of the terms and conditions
of this Contract which occurs after the effective date and
which materially and substantially increases the service required,
e) or if required to do so by any regulatory authority. Notice
of Our cancellation will be in writing and delivered to You
at Your address at least thirty (30) days prior to cancellation.
If We cancel this Service Contract, Your refund will be based
on 100% of the unearned pro rata Service Contract price.
11. SERVICE
CONTRACT PROVIDER (OBLIGOR):
AIGWS
is the Obligor and Provider under this Service Contract except
in California, Oklahoma and Wisconsin. AIGWS can be contacted

Number 1-800-250-3819 or Warranty@aig.com.
The Dealer is the Obligor in those states which require the
Dealer to be the obligor. Warranty Corporation of America
is the administrator of this service contract.
12. CONTRACTUAL
LIABILITY INSURER: If You reside in any of
the following states: AL, AK, CO, CT, DE, DC, GA, HI, ID,
IL, IN, IA, KS, KY, LA, ME, MD, MA, MI, MN, MO, MT, NE, NV,
NH, NJ, NM, ND, OH, OR, PA, RI, SC, SD, TN, TX, UT, VT, WA,
WV, WI or WY, this ESC is secured by a contractual liability
insurance policy provided by Illinois National Insurance Company,
175 Water St, 20th Floor, New York, NY 10038 and
telephone number (800) 250-3819. If, within sixty (60) days,
We have not paid a covered claim, provided You with a refund
or You are otherwise dissatisfied, You may make a claim directly
to the insurance company.
If
You reside in any of the following states: AR, CA, FL, MS,
OK, NY, NC or VA, this ESC is secured by a contractual liability
insurance policy provided by New Hampshire Insurance Company,
175 Water St, 20th Floor, New York, NY 10038 and
telephone number (800) 250-3819. If, within sixty (60) days,
We have not paid a covered claim, provided You with a refund
or You are otherwise dissatisfied, You may make a claim directly
to the insurance company.
If You reside in one of the following states,
these provisions apply to You:
ARIZONA: If your written notice
of cancellation is received prior to the expiration date,
the Administrator shall refund the remaining pro-rata price,
regardless of prior services rendered under the Plan.
CALIFORNIA: AIG Warranty
Guard, Inc. (AIGWS) is the Obligor under this Plan.
AIG Warranty Guard, Inc. (AIGWG) and AIG Warranty Services
Insurance Agency, Inc. can be contacted at 500 West Madison
Street, Chicago, IL 60661.
CONNECTICUT: The expiration date
of this Plan shall automatically be extended by the duration
that the product is in our custody while being repaired.
In the event of a dispute with the Administrator, you may
contact The State of Connecticut, Insurance Department, PO
Box 816, Hartford, CT 06142-0816, Attn: Consumer Affairs.
The written complaint must contain a description of the dispute,
the purchase price of the product, the cost of repair of the
product and a copy of the Plan
GEORGIA: Cancellation will comply
with Section 33-24-44 of the Georgia Code.
KANSAS: This Plan is not an insurance
policy.
NEVADA: If you cancel this
Plan, no deduction shall be made from the refund for the cost
of any service received.
NORTH CAROLINA: The purchase of this
Plan is not required either to purchase or to obtain financing
for a home appliance.
OKLAHOMA: The Dealer is the Obligor
under this Plan. This Plan is not issued by the manufacturer
or wholesale company marketing the product covered by this
Plan. This Plan will not be honored by such manufacturer
or wholesale company. If either you or we cancel this
Plan, the return of the Plan price will be based upon one
hundred percent (100%) of the unearned pro rata price of the
Plan, less the cost of any service received.
SOUTH CAROLINA:
To prevent any further damage, please refer to the owner's
manual. In the event the service contract provider does
not provide covered service within (60) days of proof of loss
by the contract holder, the contract holder is entitled to
apply directly to the New Hampshire Insurance Company.
If the insurance company does not resolve such matters within
(60) days of proof of loss, they may contact the SC Department
of Insurance, P.O. Box 100105, Columbia, SC 29202-3105,
(800) 768-3467.
TEXAS: If You purchased
this Service Contract in Texas, unresolved complaints concerning
a provider or questions concerning the registration of a service
contract provider may be addressed to the Texas Department
of Licensing and Regulations, PO Box 12157, Austin, TX 78711,
telephone number (512) 463-2906 or (800) 803-9202.
UTAH: Coverage afforded under
this Plan is not guaranteed by the Utah Property and Casualty
Guarantee Association.
WISCONSIN: This Contract is subject to limited regulation
by the Wisconsin Office of the Commissioner of Insurance.
Warranty Corporation of
America is the Obligor under this Contract. This Contract
shall not be cancelled due to unauthorized repair of the covered
product. If You cancel this Contract, no deduction shall be
made from the refund for the cost of any service received.
This Contract is backed by a contractual liability policy
with limits of liability of $5000 per claim and $25,000 in
aggregate per plan.

Throughout
this Replacement Plan, the words, “We”, “Us”, and “Our” refer
to AIG Warranty Services and Insurance Agency, Inc. (“AIGWS”).
The words, “You” and “Your” refer to the Contract Holder or
the person to whom the Replacement Plan was properly transferred.
TERM
and COVERAGE:
For re-manufactured laptop computers covered by a Replacement
Plan, the term of this Replacement Plan commences at date
of product purchase and is inclusive of the manufacturer’s
warranty. For all other products qualifying for sale with
a replacement plan, the term of this contract commences after
the expiration of the manufacturer’s warranty. The term length
purchased can be confirmed by referencing your sales receipt.
This Replacement Plan covers qualifying products sold in USA
only.
1. WHEN
YOUR COVERED PRODUCT FAILS TO OPERATE:
For
service on Your product, during the manufacturer’s warranty
period, please contact the manufacturer at the number or website
listed in Your Owner’s Manual. After the manufacturer’s
warranty expires, please call 1-888-969-2260.
· Your
product will be replaced rather than repaired.
· You
will be given a Return Authorization Number (RA#), which needs
to be marked on the outside of the shipping carton.
· You
will be required to ship the covered product to a designated
location.
· You
are responsible for the cost of freight and insurance to the
point of replacement.
· Upon
inspection of the covered product, if your product qualifies,
You will be sent one of the following: A new or re-manufactured
product of like kind and quality; a merchandise replacement
voucher; a gift certificate or a check. The value of each
of these items will be equal to the original selling price
of the product covered under this Replacement Plan, excluding
taxes, shipping and handling.
· Once
the covered product is replaced, this Replacement Plan is
consider fulfilled.
INTERNATIONAL SERVICE:
If
Your product requires replacement and is located outside of
Canada or the U.S.A., please call 01-770-417-2189
or
send an e-mail to

If
the product is still covered by the manufacturer’s warranty,
You will need to contact the manufacturer for service locations
worldwide. If the product is out of the manufacturer’s warranty
period, We will issue a cheque to You for the original purchase
price of the covered product, excluding taxes, shipping and
handling.
2. ADDITIONAL
COVERAGES:
·
This
Plan provides power surge protection in excess of any other
insurance coverage, from date of purchase of this Replacement
Plan.
·
This
Plan covers manufacturer’s defects in materials and workmanship.
·
This
Plan provides coverage for product failures due to dust, heat,
humidity and normal wear and tear.
·
Laptop
Coverage –
This
service contract covers LCD screens.
3. REPLACEMENT
